Local democracy

This section contains information relating to all aspects of lcoal democracy and good governance at the local level. The Commonwealth principles on good practice for local democracy and good governance - known as the Aberdeen Agenda - which have been adopted by all CLGF members and are incorporated in the Commonwealth Charter, set the framework for the promotion of local democracy in the Commonwealth. The materials in this section relate to the constitutional and legal provisions for local government and include a range of studies, policy and training materials on local elections, leadership, community participation, representative local government, local government management and partnerships between local government and other key stakeholders such as traditional authorities.

Structural reform, revenue adequacy and optimal tax assignment in local government

A striking feature of local government reform in many Commonwealth countries has been a heavy reliance on structural reform, often in the form of forced local council amalgamation. This paper argues that the long-run success of structural change in local government hinges on several key factors, not least that voluntary rather than compulsory council mergers have a far greater chance of success. A second key ingredient resides in a high degree of local autonomy in both the composition and operation of decentralized governmental functions. A third vital factor lies in ensuring that revenue and tax assignment is sufficient to provide local government with financial autonomy. Finally, adequate powers of taxation need to be accorded to local government and this requires careful consideration of the types of taxes most suited to local government.

Developmental Local Government in South Africa: Institutional fault lines

This paper provides a brief introduction to the recent history of, as well as the legal and policy framework for, local government in South Africa. It discusses the transformation of local government from a racially configured, illegitimate arm of the apartheid government into a system designed to produce developmentally oriented municipalities. The progress made by South African municipalities towards realising the vision of developmental local government is remarkable and unprecedented. Over the last 13 years, municipalities have embarked on the extension of infrastructure and development, whilst absorbing fundamental changes to their internal governance and management arrangements, financial management systems and intergovernmental responsibilities. The new local government system offers great potential for the realisation of a better life for all citizens, facilitated by a new generation of municipalities. However, the challenges remain huge and some of these can be attributed to institutional fault lines. These include challenges that come with large, inclusive municipalities, new executive systems and the political appointment of senior officials. The paper also identifies the downside of overzealous institutionalisation of community participation. With regard to intergovernmental relations, the paper highlights the need for a clearer definition of local government mandates and a greater recognition of the role of big cities. The current insistence on comprehensive intergovernmental alignment of policies and budgets is questioned, and suggestions are made to substitute this with an approach of selective alignment around key national priorities.

Unlocking research for local government

Local government needs evidence, from the apparently mundane but nonetheless critical (‘What choice of cladding will minimise the risk of fire spreading?’) to extraordinary insights (‘How do people choose what to eat and whether to be active?’, ‘What skills will today’s youngsters need in the jobs market of 2050?’). In 2014, Solace supported the initial Local Government Knowledge Navigator (LGKN) report, From Analysis to Action: Connecting Research and Local Government in an Age of Austerity, which demonstrated that: 1. Councils have a wide range of evidence needs; 2. There is relevant research and expertise in academia but local government doesn’t make the most of this; 3. There are some impressive examples of collaboration between academia and local authorities but engagement is inconsistent, and often depends on existing links between individual researchers and local government officers or politicians; and 4. There is a need for a change of culture in both communities, and the development of more systematic approaches to achieving connectivity between them.

Democracy, decentralization, and district proliferation: The case of Ghana

In many developing countries, a rhetorical commitment to decentralization often superficially manifests through the creation of new or smaller administrative units at the sub-national level. In democracies in particular, this raises the question of whether sub-national unit proliferation is intended for winning popular support in elections or addressing the concerns of local citizens. This paper analyzes the motivations for district creation by focusing on Ghana, which is oft-considered one of Africa's more committed countries to decentralization. At the same time, successive governments repeatedly have divided the country into more districts in an espoused effort to more effectively bring services closer to citizens. With an in-depth focus on the most recent increase from 170 to 216 districts between 2008 and 2012, this paper employs national and district census, socioeconomic, and electoral data to examine which districts were split and why. Instead of representing a source of patronage to swing voters or a divide-and-rule strategy in opposition strongholds, the study finds that the incumbent party at the time, the National Democratic Congress (NDC), used re-districting as a tactic of malapportionment and predominantly targeted non-competitive districts where gaining an additional legislative seat in subsequent elections was more likely. Evidence suggests that this pattern is not specific to the NDC and that previous district splitting under the New Patriotic Party (NPP) also focused disproportionately on that party's safe seats. Overall, the paper emphasizes the need for according greater consideration to underlying institutional aspects, particularly electoral rules and executive-legislative relations, when analyzing the motivations for territorial reforms.

Local Government in the South Pacific Islands

In this paper we seek to answer some basic questions about the condition of local government in the Pacific. Firstly, we examine what is meant by ‘local government’ in the various islands and for that matter how Pacific Island states have perceived and accepted local government institutions in practice; second, we ask basic questions about existing legal and constitutional recognition and powers; and third, we provide initial findings on current per capita expenditure and local government financial viability in a number of Pacific cities and towns. We also make some observations on current moves towards local government reform.
