This section contains information relating to all aspects of lcoal democracy and good governance at the local level. The Commonwealth principles on good practice for local democracy and good governance - known as the Aberdeen Agenda - which have been adopted by all CLGF members and are incorporated in the Commonwealth Charter, set the framework for the promotion of local democracy in the Commonwealth. The materials in this section relate to the constitutional and legal provisions for local government and include a range of studies, policy and training materials on local elections, leadership, community participation, representative local government, local government management and partnerships between local government and other key stakeholders such as traditional authorities.

Involving the third sector in local service delivery in Bangladesh: why and how?

Commonwealth Journal of Local Governance, Issue 15/16, June 2015 The rise of involuntary and non-government efforts to deliver services in Bangladesh has opened the way for local government units to involve many community and voluntary organisations (CVOs) and non-governmental organisations (NGOs) – collectively described as the ‘third sector’ – in delivering local services. This article attempts to set out how the third sector can be incorporated into the stream of local service delivery. It analyses the rationale behind the engagement of the third sector in this area. It also looks at suitable mechanisms to enable local government institutions (LGIs) and third sector organisations to meet community objectives seamlessly, transparently and fairly. During the last two decades or so, many third sector organisations have collaborated with public sector organisations including LGIs regardless of any specific long term strategies. To involve the third sector in local service delivery there should be some clear cut standard procedures, strategies including commissioning, partnership, competitive contracting and co-production. The article concludes that, given the current situation of LGIs in Bangladesh, only co-production is a suitable mechanism for incorporating the third sector into local service delivery.

Decentralised governance and planning in India: case study of a tribal district

Commonwealth Journal of Local Governance, Issue 15/16, June 2015 This paper examines the process of the formulation of decentralised planning in the Tribal regions of Odisha, a state located in eastern part of India, while examining the powers devolved to the local governments in such regions in the state to formulate plan, and the ground reality of the preparation of such plans in the context of the implementation of the Provisions of Panchayats (Extension to Scheduled Areas) Act (PESA Act). Formulation of decentralised planning in Odisha was taken up in the year 2008. However, based on the secondary data and interacting with the various people in field, the paper has revealed that “structural impediments” and “functional incapacity” of the local governments in the Scheduled Areas have hampered the spirit of such institutions with regard to the planning and implementation of the development programmes. The paper argues that decentralised plans should be realistic, based on the effective utilisation of local resources, and the local development issues should be prioritised and implemented accordingly. The paper suggests policy measures such as effective participation, prioritisation of development needs, and rationalisation of the required and available funds, considering the significance of the PESA Act. While doing so, the issues of the tribals should receive priority.

Decentralisation, participation and boundaries of transformation: Forest Rights Act, Wayanad, India

Participation and decentralisation have been shown to yield democratic outcomes in terms of efficiency, accountability and transparency through citizen engagement and devolution of powers. It has been a matter of debate whether they also benefit marginalised communities like the indigenous peoples. This paper analyzes the implications of decentralised governance in a tribal zone in India using the case of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006 - the Forest Rights Act. The effects of the Act are studied in the district of Wayanad, Kerala, through the theoretical framework of transformative decentralisation and spatial politics of participation. The key objectives of the Act - securing tenure and access to Minor Forest Produce - have achieved limited success in Wayanad as a result of a narrowly construed ideas of people’s participation. While the process prescribed by the Forest Rights Act has the potential to create new spaces for participation, most of these spaces remain closed in Wayanad. The absence of a larger vision and a radical motive to engage with the underlying patterns of domination and subordination in society has confined the process of decentralisation to its technocratic essentials, raising questions on the extent to which the Act can pave the way for transformation.

Local democracy today and tomorrow - learning from good practice

This paper provides an overview of key trends and developments impacting local democracy and is intended to be a broad-ranging background paper to assist in discussions at a workshop organised in November 2014, which brought together academics and practitioners to explore current trends and developments in local democracy. It should be noted that there is no single world view on what local democracy is and globally there are many different systems of local governance and democracy both within and between countries. A number of key areas which have impacted on local democracy and as identified by the authors include the impact of the global financial crisis, the effects of urbanisation, rising conflicts and protests, ways in which engagements occur, ensuring inclusivity and the need for a developmental approach to local governance. Lessons learnt and challenges include the effects of decentralisation, increased participation, building skills, ensuring openness and transparency and ensuring effective and efficient service delivery.
