Local democracy

This section contains information relating to all aspects of lcoal democracy and good governance at the local level. The Commonwealth principles on good practice for local democracy and good governance - known as the Aberdeen Agenda - which have been adopted by all CLGF members and are incorporated in the Commonwealth Charter, set the framework for the promotion of local democracy in the Commonwealth. The materials in this section relate to the constitutional and legal provisions for local government and include a range of studies, policy and training materials on local elections, leadership, community participation, representative local government, local government management and partnerships between local government and other key stakeholders such as traditional authorities.

Developmental Local Government in South Africa: Institutional fault lines

This paper provides a brief introduction to the recent history of, as well as the legal and policy framework for, local government in South Africa. It discusses the transformation of local government from a racially configured, illegitimate arm of the apartheid government into a system designed to produce developmentally oriented municipalities. The progress made by South African municipalities towards realising the vision of developmental local government is remarkable and unprecedented. Over the last 13 years, municipalities have embarked on the extension of infrastructure and development, whilst absorbing fundamental changes to their internal governance and management arrangements, financial management systems and intergovernmental responsibilities. The new local government system offers great potential for the realisation of a better life for all citizens, facilitated by a new generation of municipalities. However, the challenges remain huge and some of these can be attributed to institutional fault lines. These include challenges that come with large, inclusive municipalities, new executive systems and the political appointment of senior officials. The paper also identifies the downside of overzealous institutionalisation of community participation. With regard to intergovernmental relations, the paper highlights the need for a clearer definition of local government mandates and a greater recognition of the role of big cities. The current insistence on comprehensive intergovernmental alignment of policies and budgets is questioned, and suggestions are made to substitute this with an approach of selective alignment around key national priorities.

Constitutional Law, Democracy and Development: Decentralisation and Governance in Uganda

Uganda, like many African countries in the 1990s, adopted decentralisation as a state reform measure after many years of civil strife and political conflicts, by transferring powers and functions to district councils. The decision to transfer powers and functions to district councils was, in the main, linked to the quest for democracy and development within the broader context of the nation state. This book’s broader aim is to examine whether the legal and policy framework of decentralisation produces a system of governance that better serves the greater objectives of local democracy, local development and accommodation of ethnicity. Specifically, the book pursues one main aim: to examine whether indeed the existing legal framework ensures the smooth devolution process that is needed for decentralised governance to succeed. In so doing, the book seeks, overall, to offer lessons that are critically important not only for Uganda but any other developing nation that has adopted decentralisation as a state-restructuring strategy. The book uses a desk-top research method by reviewing Uganda’s decentralisation legal and policy frameworks.

Local integrity system assessment Kenya - Kisumu & Kwale Counties

This Local Integrity System (LIS) Assessment is one of five pilots undertaken by Transparency International (TI) national chapters from Africa, Latin America, Europe and the Middle East to test the relevance and applicability of the LIS Assessment approach in different national and local contexts. The pilots took place between September and December 2013. In Kenya, the assesment was conducted in Kwale and Kisumu Counties between September and December 2013.

Corruption in UK local government: the mounting risks

Transparency International’s report ‘Corruption in Local Government: The Mounting Risks’ warns that an unintended consequence of recent changes, such as those made in the Localism Act and the Local Audit and Accountability Act, may be the creation of an enabling environment for corruption. The report notes that experts hold widely different views about the scale and prevalence of corruption in local government, but there was general consensus that recent changes would increase the risk of corruption happening in future. It identifies sixteen recent legislative changes which increase the risks, as well as other trends such as the decline in scrutiny by local press and the move to more private sector out-sourcing. This report includes twenty-two recommendations, including that the Government should conduct a corruption risk assessment and strengthen whistleblowing procedures.
